The following terminology applies to these Terms and Conditions (Terms), Privacy Policy, and any disclaimer notice and any or all Agreements on this Website: "Customer", "You", "User" and "Your" refers to you, the person accessing this Website and using my Services or Products, and therefore accepting these terms and conditions. "User Account" or "Account" shall mean the online account maintained by the User at the Website to access the Services. "I", "my", and "Kim Klassen" refers to me, Kim Klassen, the owner and operator of this Website. "Party" or "Parties" refers to both the Customer/User and myself, or either the Customer or myself. "Product" refers to a unique product I provide as a result of my commitment and services ("Services").

Any use or access by anyone under the age of 16 is prohibited unless permitted by the laws of your country of residence, and certain regions and/or Products may have additional requirements and/or restrictions. All rights not expressly granted to you under these Terms are reserved to me.

Services / Products

This Website allows you to purchase an online course or digital tool (Product) for a fee. I may at my sole discretion engage third-party service providers from time to time to provide certain Services. Each such purchase is intended to be used only by one person, unless specified otherwise under the Product's details. You are not allowed to share your purchase and/or provide access to such purchase to a third party. Please acknowledge that the Products I provide for a fee paid through my Website constitute my intellectual property and may not be exploited in any way prohibited by these Terms.

Prompt Studio

Prompt Studio is a paid digital tool that provides access to my curated library of AI image prompt styles. Access to Prompt Studio requires a fee paid through this Website.

By purchasing access to Prompt Studio, you agree to the following:

Personal use only. The prompts, prompt frameworks, style descriptions, and all associated content within Prompt Studio are for your personal, non-commercial use only. You may use the generated prompts to create images for your own projects, but you may not resell, sublicense, or redistribute the prompts or the underlying prompt framework in any form.

No AI training. You may not use the prompts, prompt structures, or any content from Prompt Studio to train, fine-tune, or develop AI models, datasets, or derivative tools of any kind.

No redistribution. The prompt library, style names, and the framework behind Prompt Studio represent significant original work. You may not copy, share, publish, or distribute any portion of the prompt content — in whole or in part — without my written permission.

One licence per purchase. Each purchase grants a single-user licence. You may not share your account credentials or provide access to Prompt Studio to any third party.

I reserve the right to update, modify, or discontinue any style, feature, or access tier within Prompt Studio at any time. Access is provided on an ongoing basis, and I make no guarantee of permanent availability.

MakeSpace

MakeSpace is a free, browser-based checklist tool available on this Website. No account or payment is required to use MakeSpace.

Your data stays in your browser. MakeSpace stores all checklist data locally in your browser using localStorage. I do not collect, store, or have access to any checklists you create. Your data is never transmitted to my servers. If you clear your browser data, your checklists will be lost — I am not responsible for any such loss.

The tool is my intellectual property. While the checklists you build are entirely your own, MakeSpace itself — including its design, interface, code, and structure — is my original work and remains my intellectual property. You may not copy, reproduce, reverse-engineer, or redistribute the tool or its code.

No guarantees of availability. MakeSpace is offered as a free resource and may be modified, paused, or discontinued at any time without notice. I am not liable for any loss of access or data resulting from such changes.

Personal use. MakeSpace is intended for personal, non-commercial use. You may not embed, redistribute, or commercialise the tool without my written permission.

License

Subject to these Terms and my policies, I grant you a limited, personal, non-exclusive, non-transferable, and revocable licence to use my Services and Products. You may use my Products only for your personal, non-commercial use, unless you obtain my written permission to do otherwise. You also agree that you will access and/or use only one User Account, unless expressly permitted by me, and you will not share access to your User Account or access information with any third party. Using my Services or Products does not give you ownership of or any intellectual property rights in my Services or the Products you access.

Privacy

I am committed to protecting your privacy. I will only use information collected from individual Customers — particularly email addresses — to facilitate and deliver orders as part of my commitment to provide the Services you have paid for. As I work to provide you with better products and resources, I will also use your email to share information about my other offerings. You can opt out at any time by pressing the unsubscribe button found in every email I send. I will continually review my systems and data to ensure the best possible service.

Support

I provide customer support to registered Users via email. If you experience any difficulties using a Product, please contact me at kim@kimklassen.com with the subject line "Support". I will not be liable or responsible for your own technical issues, internet speed, or other matters related to your access, device, or location. I reserve the right to determine solely whether a difficulty exists on my end.

Disclaimer

The information on this Website is provided on an "AS IS" basis. To the fullest extent permitted by law, I: (i) exclude all representations and warranties relating to this Website and its content, or which may be provided by any affiliates or third parties, including in relation to any inaccuracies or omissions; (ii) exclude all liability for damages arising out of or in connection with your use of this Website. This includes, without limitation, direct loss, loss of business or profits, damage caused to your computer, software, systems and programs and the data thereon, or any other direct or indirect, consequential, and incidental damages.

WITHOUT LIMITING THE FOREGOING, I DO NOT WARRANT THAT (A) THE PRODUCTS WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS, (B) THE PRODUCTS WILL NOT EXPERIENCE OUTAGES OR OTHERWISE BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE, OR (C) THAT DEFECTS WILL BE CORRECTED. YOU ASSUME ALL RISK SUSTAINED FROM USE OF THE PRODUCTS.

Fees

I offer paid Products for a fee. You are responsible for paying all fees and applicable taxes in a timely manner. When you make a purchase, you agree not to use an invalid or unauthorized payment method. I reserve the right to disable access to any Product for which adequate payment has not been received. Unless otherwise stated, all fees are quoted in U.S. Dollars. You are solely responsible for any sales, value-added, withholding, or similar taxes that apply to your purchase.

You may purchase my Products via credit card or PayPal. By choosing to pay by credit card, you authorise me to charge your credit card or bank account for the applicable fee. If you choose to pay via PayPal, you further authorise me to use a third party to process payments. By purchasing any Product through my Website, you consent to abide by such third-party payment providers' terms and conditions and privacy policies. I have no control over those policies. IF YOU DO NOT AGREE to such third-party terms, DO NOT PURCHASE ANY PRODUCT. It is your sole responsibility to find, read, and understand any third-party policies.

Customer Restrictions

As a Customer, you agree not to:

  • Circumvent, disable, or otherwise interfere with security-related features of the Website
  • Disparage, tarnish, or otherwise harm, in my opinion, the Website and/or the Services
  • Use any Product in a manner inconsistent with applicable laws or regulations
  • Interfere with, disrupt, or create an undue burden on the Services or the networks connected to them
  • Share access to any Product with a third party (unless otherwise permitted in writing)
  • Lease, sell, grant, or otherwise exploit my Products in a way prohibited by these Terms
  • Attempt to bypass any measures designed to prevent or restrict access to the Service or Website

User Content and Conduct

Where my Services enable you to share content ("User Content"), you retain all intellectual property rights in, and are responsible for, the User Content you create and share. However, by submitting User Content you grant other Users and me the right to share your User Content via any social media platform.

As a user of this Website, you agree not to post any Prohibited Content, including:

  1. Profane language or content
  2. Content that promotes discrimination on the basis of race, religion, gender, marital status, familial status, national origin, age, mental or physical disability, sexual orientation, gender identity, source of income, or other protected status under applicable law

Term and Termination

I may terminate your access to all or any part of this Website, Services, and/or Products at any time, with or without cause, with or without notice, effective immediately. You can stop using my Services at any time. You may delete your User Account through Website features or by notifying me at kim@kimklassen.com. When you delete your User Account, I will delete your data, although this may not take place immediately.

Indemnity

You agree to indemnify, defend, and hold harmless Kim Klassen and any affiliates, licensors, and service providers, and all officers, directors, owners, agents, or licensors of any of the foregoing (collectively, the "Indemnified Parties") from and against any and all losses, damages, liabilities, and costs, including reasonable attorney's fees, in connection with any claim arising out of your use of this Website or Products, or any breach by you of these Terms. Under no circumstances shall I be liable for any amount exceeding the fee paid for the Services or Products ordered.

Changes to These Terms

I reserve the right to revise these Terms at my sole discretion at any time. Any revisions will be effective immediately upon posting. For any material changes, I will take reasonable steps to notify you — via a banner on the website, email notification, or another method. Your continued use of the Services or Products after such changes constitutes binding acceptance of the revised Terms.

Severability

If any provision of these Terms is found to be unenforceable, this will not affect any other terms. If you do not comply with these Terms and I do not take immediate action, this does not indicate that I relinquish any rights I may have under these Terms or as granted by law.

Applicable Law and Jurisdiction

These Terms and Conditions are governed by the laws of the Province of Manitoba, Canada. The parties submit to the jurisdiction of the courts of Manitoba, regardless of conflicts of law rules.

Entire Agreement

These Terms constitute the sole and entire agreement between you and Kim Klassen regarding this Website and supersede all prior and contemporaneous understandings, agreements, representations, and warranties — both written and oral — regarding the Services, Products, and Website.
